By accessing or using the website at pasadenadeckandfence.com, by requesting a quote, or by entering into a service agreement with Advanced Pasadena Deck & Fence ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Site or services.
These Terms apply to all visitors, customers, and other persons who access the Site or engage our services.
Advanced Pasadena Deck & Fence provides residential deck building, fence installation, and related outdoor construction services in Pasadena, Texas and surrounding communities. Specific services available are described on our website and in individual project contracts.
We reserve the right to decline any project at our discretion, including projects outside our service area, projects that do not meet our safety or quality standards, or projects for which we do not have current availability.
All written estimates provided by Advanced Pasadena Deck & Fence are valid for 30 days from the date of issuance unless otherwise noted. An estimate is not a binding contract; a signed written agreement is required before any work begins.
Prices in a signed contract are fixed except in the following circumstances: (a) the scope of work is changed in writing by mutual agreement; (b) concealed conditions are discovered that were not visible or reasonably knowable at the time of estimate; or (c) material costs increase by more than 10% due to circumstances outside our control, in which case we will notify you in writing before proceeding.
Any price changes require a signed written change order before additional work is performed.
Project start dates are estimates and may be affected by weather conditions, permit processing times, material availability, or other circumstances beyond our control. We will notify you of any significant scheduling changes as soon as reasonably possible.
If you wish to cancel a signed project agreement before work begins, you must notify us in writing. Any deposit paid is non-refundable once materials have been ordered or permits have been applied for.
We reserve the right to suspend or terminate a project if payment obligations are not met or if site conditions make continuation unsafe or impractical.
Payment terms are set forth in the individual project contract. In general, a deposit is required before work begins, with the remaining balance due upon substantial completion of the project unless a different schedule is agreed in writing.
Payments not received within 10 days of the due date may be subject to a late fee as stated in the project contract. Advanced Pasadena Deck & Fence reserves the right to suspend work on any project where payment is overdue.
Accepted payment methods are described in the project contract. All payments are in U.S. dollars.
Where required by the City of Pasadena or other applicable jurisdiction, Advanced Pasadena Deck & Fence will apply for and obtain necessary building permits as part of the project scope. The cost of permits is included in the project estimate unless otherwise noted.
You are responsible for disclosing any homeowners association (HOA) rules that may affect the project. HOA approval, if required, is the homeowner's responsibility unless otherwise agreed in writing. Advanced Pasadena Deck & Fence is not liable for delays or required changes resulting from HOA review processes.
Advanced Pasadena Deck & Fence warrants that all work will be completed in a workmanlike manner consistent with industry standards. Any specific warranty terms - including duration and coverage - are stated in the individual project contract.
Manufacturer warranties on materials (such as composite decking boards) are separate from our workmanship warranty and are governed by the respective manufacturer's terms. We will assist you in understanding those warranties, but we are not responsible for honoring third-party manufacturer warranties.
Warranties do not cover damage resulting from improper use, lack of maintenance, natural events (such as flooding, storms, or extreme freeze events), unauthorized modifications, or normal wear and tear.
EXCEPT AS EXPRESSLY STATED IN A SIGNED PROJECT CONTRACT, WE MAKE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
To the maximum extent permitted by applicable law, the total liability of Advanced Pasadena Deck & Fence for any claim arising out of or related to our services or this agreement - whether based on contract, tort, negligence, strict liability, or otherwise - shall not exceed the total amount paid by you for the specific project giving rise to the claim.
In no event shall Advanced Pasadena Deck & Fence be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of use, or loss of data, even if we have been advised of the possibility of such damages.
Some states do not allow the exclusion or limitation of consequential damages, so the above limitation may not apply to you.
If a dispute arises between you and Advanced Pasadena Deck & Fence relating to our services or these Terms, we encourage you to contact us directly first so we can work toward a resolution. Most issues can be resolved quickly through direct communication.
If direct communication does not resolve the dispute, both parties agree to attempt good-faith mediation before pursuing litigation. The mediator will be a mutually agreed neutral party in Harris County, Texas.
Any legal action that cannot be resolved through mediation shall be filed in the appropriate state or federal court located in Harris County, Texas, and both parties consent to the jurisdiction of those courts.
These Terms and any dispute arising from them are governed by the laws of the State of Texas, without regard to conflict of law principles.
The content on this Site - including text, images, logos, and descriptions - is owned by or licensed to Advanced Pasadena Deck & Fence and may not be copied, reproduced, or used without our written permission.
You agree not to use the Site for any unlawful purpose, to transmit harmful or malicious content, or to interfere with the operation of the Site. We reserve the right to block access to any user who violates these Terms.
We may update these Terms at any time by posting a revised version on this page with an updated effective date. Your continued use of the Site or our services after changes are posted constitutes your acceptance of the revised Terms.
Changes to Terms do not affect signed project contracts already in place at the time of the change.
